Customer Terms of Use

These Terms govern customer use of the Badikwa Logistics marketplace, including requests, quotes, bookings, messages and reviews.

1. About Badikwa and the marketplace

Badikwa Logistics operates a digital marketplace that lets customers request moving or transport services, receive quotes from participating moving or transport businesses (“Movers”), review marketplace information, communicate through the Platform and select a Mover.

Unless a service is expressly identified as being supplied directly by Badikwa Logistics, the selected Mover is the independent service provider responsible for performing the booked moving or transport service. Badikwa provides the marketplace technology, administration and support around that arrangement.

2. Your account

You must provide accurate account information and keep your login details secure. You are responsible for activity performed through your account. You may not impersonate another person, create fraudulent accounts or use the Platform for unlawful purposes.

3. Creating a request

You must provide information reasonably needed for Movers to understand and quote for your request. Depending on the service, this may include pickup and delivery locations, moving date and time, inventory, property size, floors, stairs, access conditions, additional stops, helpers, packing or wrapping needs, special items and other relevant instructions.

If important information is inaccurate, incomplete or later changes materially, the selected Mover may ask you to correct the booking or agree to a reasonable price or scope adjustment before additional work is performed.

4. Quotes and your choice of Mover

Submitting a request does not require you to accept any quote. Movers independently decide whether to quote and determine their own quoted price. Badikwa does not require you to choose the cheapest quote.

You may consider the information displayed by the Platform, such as company profile information, marketplace level, verification status, ratings, reviews, completed jobs and the quoted amount. Marketplace badges, ratings and levels are informational and are not guarantees of a particular outcome.

Badikwa does not guarantee that a request will receive a particular number of quotes.

5. Quote windows and quote-stage messages

Each request may have a quote window. While that window is open, eligible Movers may submit quotes and quote-stage messaging may be available.

When the quote window closes, no new quotes may be submitted and the quote-stage conversation becomes read-only. Existing messages may remain available as a record.

If quotes were received before closure and no Mover has yet been selected, the Platform may continue to display those received quotes for selection where the booking remains available.

6. Booking confirmation

A booking is confirmed when you successfully select or accept a Mover’s quote through the Platform and the booking is recorded as confirmed. The accepted amount displayed to you is the agreed marketplace booking amount, subject to any later lawful change that you and the selected Mover expressly agree because the booking scope materially changed.

After confirmation, the selected Mover may receive the customer and location information reasonably needed to carry out the booking.

7. Additional work and price changes

A Mover should not change a confirmed price merely because it later decides it quoted incorrectly. A reasonable adjustment may be agreed if you add or materially change inventory, locations, access conditions, services or other information that changes the work required. Where reasonably possible, additional charges should be agreed before the extra work is performed.

8. Cancellations and refunds

You may cancel a booking subject to applicable law and the circumstances of the booking. Any cancellation charge must be reasonable and lawful, taking account of factors such as notice given, reasonable costs already incurred, work already performed and the opportunity to replace the booking.

If the Mover cancels, fails to attend or cannot perform the booking, you should report the matter through Badikwa support. Where Badikwa processed or controls relevant funds, any refund due will be handled according to the transaction circumstances and applicable law.

9. Access, inventory and safety

You should disclose unusual, fragile, valuable, very heavy, restricted or potentially hazardous items before booking where relevant. You must provide reasonably safe and lawful access to collection and delivery locations. A Mover may refuse or stop work where continuing would create a serious safety or legal risk.

10. Messages and acceptable conduct

You must use Marketplace communications lawfully and respectfully. You may not threaten or harass users, send scams or malware, share unlawful content, misrepresent your identity or deliberately use Platform introductions to bypass marketplace rules.

Badikwa may retain and review marketplace communications where reasonably necessary for support, disputes, safety, fraud prevention, legal compliance or enforcement of these Terms.

11. Reviews

Reviews must relate to genuine marketplace experiences. Reviews must not contain knowingly false information, threats, unlawful discrimination, confidential information, spam or unrelated personal attacks. Badikwa may moderate reviews that breach marketplace rules, but a genuine negative review will not be removed merely because another user disagrees with it.

12. Payments

Where payment functionality is provided, you must pay the amount presented and agreed for your booking using the available payment method. Third-party payment providers may apply their own terms. Badikwa will not add undisclosed charges to the customer price you accepted.

13. Loss, damage and disputes

If goods are lost or damaged, notify the selected Mover and Badikwa as soon as reasonably possible and provide relevant information or evidence. Responsibility will depend on the facts, applicable law, the service arrangement and any applicable insurance. Badikwa may assist the parties with communication and dispute administration.

14. Platform availability and third-party services

Badikwa aims to keep the Platform functioning, but uninterrupted availability is not guaranteed. The Platform may rely on hosting, mapping, payment, notification and other third-party services. Temporary failures, maintenance or circumstances outside reasonable control may affect availability.

15. Badikwa’s marketplace role and liability

To the maximum extent permitted by law, Badikwa is not responsible for losses caused solely by the independent acts or omissions of a customer or independent Mover. Nothing in these Terms excludes, limits or waives any consumer right or liability that cannot lawfully be excluded under South African law, including applicable rights under the Consumer Protection Act 68 of 2008.

16. Account restrictions

Badikwa may reasonably restrict, suspend or terminate access for fraud, serious or repeated breaches, abusive conduct, marketplace manipulation, unlawful activity, safety concerns or other serious misuse. Where appropriate, Badikwa may investigate before taking permanent action.

17. Privacy

Your personal information is processed according to the Badikwa Customer Privacy Policy. Privacy acknowledgement is separate from optional direct-marketing consent.

18. Changes to these Terms

Badikwa may update these Terms for legal, security, operational or marketplace changes. If a material new version requires renewed acceptance, the Platform may ask you to review and accept it before continuing.

19. Governing law

These Terms are governed by the laws of the Republic of South Africa. Electronic use and acceptance of the Platform operate within South Africa’s electronic-transactions framework, including the Electronic Communications and Transactions Act 25 of 2002. Nothing in these Terms prevents a consumer from exercising rights available under applicable South African consumer-protection law.

20. Electronic acceptance

When you tick the required acceptance box during registration, or select Accept & continue for an updated version, Badikwa records the customer account, document versions and acceptance date/time. That electronic acceptance forms part of the Platform record of the terms presented to you.
